NEXT Pitch Agency (“NEXT Pitch,” “we,” “us,” or “our”) provides educational guidance and pathway support for soccer players and families exploring U.S. college soccer and, where appropriate, academy options. We operate primarily as an advisory and support agency — not as a university admissions office, visa authority, or athletic governing body.

Depending on the engagement, Services may include player evaluation, university matching guidance, recruiting education and outreach support, profile and film guidance, application process orientation, academy pathway advice, and related communication support.

Unless we sign a separate written service agreement with you, website content, Instagram messages, emails, and informal conversations are informational only and do not create a paid representation contract.

We do not guarantee scholarships (athletic or academic), roster spots, coach interest, admission decisions, visas, eligibility determinations, playing time, or any specific outcome.

Results depend on the athlete’s ability, academics, English proficiency, timing, market demand, program needs, and decisions made solely by colleges, coaches, and authorities. Any examples or past pathways shared are illustrative, not promises.

Governing bodies such as the NCAA, NAIA, NJCAA, and others — not NEXT Pitch — determine eligibility and amateur status. Rules change and can be complex.

You are solely responsible for confirming with the relevant compliance office and governing body that any opportunity you pursue will not jeopardize eligibility, amateur status, scholarships, or immigration status. We do not provide legal, immigration, or compliance rulings.

You agree to provide truthful athletic, academic, medical (if shared), and contact information. Misleading film, stats, grades, or identity may lead us to suspend Services and may harm recruiting outcomes.

Parents or guardians engaging on behalf of a minor represent that they have authority to do so and that the minor’s use of the Services is supervised as required by applicable law.

If you ask us to support recruiting outreach, you authorize us to share relevant profile materials (such as contact details, academics summary, athletic résumé, photos, and video links you provide) with college coaches or programs for that purpose.

With your consent, we may also use first name, position, pathway story, photos, or video in educational or promotional materials about NEXT Pitch. You may withdraw promotional consent by contacting us; we will stop new uses going forward where reasonably practicable.

You may use the site for lawful, personal, non-abusive purposes. You may not attempt to disrupt the site, scrape in a way that harms service integrity, upload malware, impersonate others, or misuse inquiry forms.

Content on the site (text, branding, design, logos, and media we own) is protected by intellectual property laws. You may not copy or reuse it for commercial purposes without our written permission.

Our site and Services may link to Instagram, universities, associations, tools, or other third parties. Those services are governed by their own terms and privacy policies. We are not responsible for third-party content or practices.

If paid Services apply, fees, deliverables, refunds, and timelines will be set out in a separate written agreement or invoice. Website browsing alone does not create a fee obligation.

If a separate agreement conflicts with these Terms on a specific paid engagement, that agreement controls for that engagement.

THE SERVICES AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXT PITCH AND ITS FOUNDERS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST OPPORTUNITIES, SCHOLARSHIPS, ADMISSIONS, OR ELIGIBILITY OUTCOMES.

OUR TOTAL LIABILITY ARISING OUT OF THE SERVICES OR SITE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SPECIFIC PAID SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM — OR, IF YOU PAID NOTHING, ONE HUNDRED U.S. DOLLARS (USD $100).

You agree to indemnify and hold harmless NEXT Pitch from claims arising out of your misuse of the Services, inaccurate information you provide, or your violation of these Terms or applicable law — except to the extent caused by our willful misconduct.

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the site or Services after updates constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules, unless a mandatory consumer protection law in your place of residence requires otherwise. Courts in Tokyo, Japan shall have exclusive jurisdiction, subject to any non-waivable consumer rights.
